TemporaryInked™ Tattoos (hereinafter, "TemporaryInked™," "We," "Us," "Our") is offering a mobile messaging program (the "Program"), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and our Messaging Privacy Policy

By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the "Dispute Resolution" section below. In arbitration there is less discovery and appellate review than in court. Please review carefully.

By opting in to or participating in any of our Programs, you represent and warrant that you do so because of a genuine desire to receive discounts, promotions, and other news or information from Us and not because of a desire or intent to initiate litigation or bring legal claims against any party. If you have requested to receive messages with a desire to bring legal claims against Us or any vendors acting on our behalf, then you shall immediately unsubscribe using the instructions set forth below and agree to indemnify Us and/or those vendors for any expenses, including attorneys’ fees, associated with defending such claims.

This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts (including those in the "Other Terms and Policies" section below). Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the Program.

1. User Opt In

Consent to Receive Recurring Automated Messages:
You agree to receive recurring automated promotional and personalized marketing text (e.g., SMS, MMS, and RCS) messages (including cart reminders) from TemporaryInked™, including messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. You further consent to receiving messages that include artificial or prerecorded voices. By providing your phone number, you represent and warrant that you are providing your own phone number, and not someone else’s, and that you are a legally-authorized user of this phone number. Consent to receive automated marketing messages is not a condition of any purchase. While you consent to receive messages sent using an autodialer, this shall not be interpreted to suggest or imply that any or all of Our mobile messages are sent using an automatic telephone dialing system ("ATDS" or "autodialer"). Message and data rates may apply. Message frequency varies.

No Time of Day Restrictions:
While efforts are made to limit delivery of messages outside reasonable hours, you understand and agree that we cannot target messages by geographic location. Technical issues, such as network congestion or your phone being disconnected from service, can result in messages being delivered at unexpected times. Therefore, your consent includes receipt of messages 24-hours per day. Your consent supersedes any state or federal regulation that might otherwise restrict delivery.

Consent to Receipt of Electronic Information and E-Sign:
You understand that applicable law may require us to provide certain information in writing. By opting in, you authorize Us to provide this information electronically. You may withdraw this consent, update your information, or request a paper copy by emailing care@temporaryinked.com To access and retain a copy of this webpage, you need:
(i) a device with web browser and internet access, and
(ii) storage or a printer to retain a copy.

Disclosure of Data and One-Time Messages to Identify Device and Prevent Fraud:
You authorize the use or disclosure of information about your account and device by TemporaryInked™ or service providers to help identify you or prevent fraud. You consent to one-time passcodes or messages to confirm your intent to subscribe to our recurring message program. See our Messaging Privacy Policy for details.

2. User Opt Out

If you do not wish to continue participating, reply STOP, END, CANCEL, REVOKE, OPT OUT, UNSUBSCRIBE, or QUIT to any message. You may receive a confirmation message. Only these options are recognized. Requests that modify or misspell these keywords may not be processed, and we are not liable for any failures to honor such requests. Other methods, including verbal requests, may not be deemed valid. Our Do Not Call Policy is attached as Appendix A.

3. Other Terms and Policies

You also agree to our Messaging Privacy Policy, TemporaryInked™ Terms of Service, and Privacy Policy.

4. Program Description

Users who opt into the Program can expect to receive messages concerning marketing, promotions, payment, customer support, delivery (order confirmations, tracking info, shipping updates), other transactional messages, and sale of goods and services. Messages may include checkout reminders.

5. AI-Generated Message Content

From time to time, TemporaryInked™ may use generative AI services from third parties to develop or suggest message content, including AI-generated voices. Some messages may be tailored to your interests. Use of these AI services does not make third parties responsible for messages.

6. Message Frequency, Cost, and Changes

Message and data rates may apply. You agree to receive messages periodically at our discretion. Frequency may vary (daily, weekly, monthly). We may change the short code or phone number messages are sent from at any time.

7. Support Instructions

For support, text HELP to the number you received messages from or email care@temporaryinked.com Email is not an acceptable opt-out method.

8. RCS and MMS Disclosure

The Program may send SMS or MMS messages if your device does not support RCS. SMS will be sent if MMS is unsupported.

9. Disclaimer of Warranty

The Program is offered "as-is." Not all devices or areas are supported. We are not liable for delayed or undelivered messages, which are subject to carrier or network conditions.

10. Supported Devices

Not all mobile devices are supported. Delivery may fail due to device or carrier limitations.

12. Age Restriction

Users must be 13+. Users aged 13–18 require parental consent.

13. Prohibited Content

Users may not send fraudulent, abusive, obscene, illegal, or harmful content over the platform.

14. State Telemarketing Law Compliance

We comply with applicable telemarketing laws. Area codes may be used to determine state residency for compliance. Messages responding to keywords, opt-ins, or support requests do not constitute unsolicited telemarketing calls.

15. Subscribers Located in Texas

For Texas subscribers, "customer" and "establishment" are broadly defined and include online stores.

16. Dispute Resolution & Arbitration

All disputes shall be resolved via binding, individual arbitration. No class actions or jury trials. Mandatory informal resolution applies before arbitration. Arbitration follows New Era ADR rules. Arbitration decisions are final and binding.

17. Miscellaneous

You represent that you have authority to agree to these terms. Any unenforceable provisions are limited to the minimum extent necessary, and the rest remains in full force. Terms may change, and continued participation constitutes acceptance.

Appendix A – TemporaryInked™ Do Not Call Policy

We comply with the TCPA and related regulations. We do not send marketing messages to numbers without prior express consent or on our internal Do Not Call list. To be added to our Do Not Call list:

1. Reply STOP, END, CANCEL, REVOKE, OPT OUT, UNSUBSCRIBE, or QUIT to any SMS message.

2. Contact care@temporaryinked.com with your phone number.

Numbers remain on the Do Not Call list indefinitely unless new consent is given.
